I agree to a certain extent, but the world has changed over the decades and there is now an expectation in much of the world that those who operate dangerous places have an obligation to treat them as such and thus put in a reasonable effort to secure those places. In this case all your conditions were not in place - the yard was not fully fenced (there were several methods to gain access to the yard that had no signage or gate/fencing and there was a gate that didn't latch properly. DB were aware that kids / others trespassed on a regular basis because they had a part-time security patrol to deter it, and the signage on the signal box had been removed by the trespassers. Thus knowing that they had a problem DB chose to at best do a partial job, at worst ignore the problem (they could have fixed things, fenced off access where appropriate, demolished the former signal box (or at the very least done a proper job of making it inaccessible), etc. While there is no way to know, one would suspect that if DB had been able to demonstrate that they had made efforts to secure the yard then the court outcome would have been very different, and perhaps even the life outcome of the kid in question if perhaps proper fences / gates / etc had been there to be a deterrent.
  2. First, the kid didn't die so death by misadventure would seem to be inapplicable. Second, I suspect part of this issue is that it wasn't just one issue that resulted in the injuries, but rather the combination of a number of things that indicated DB didn't take the issue seriously particularly given the ample evidence that they had an ongoing trespassing problem, particularly at the abandoned signal box. Also possibly considered would be the relevance to the company - the BBC article indicated that DB Cargo UK had a pre-tax profit of £9 million and a quick search revealed that DB (the ultimate owner of DB Cargo UK) in its latest half year report had an after-tax profit of around €200 million. Another thing to consider (though I don't know if the courts did or not) is the ongoing costs to the UK taxpayer - this is a teenager who has lost both legs as well as serious damage to hands which will mean ongoing care costs for the rest of his life, of which the judgement can go a long way to helping cover.
  3. From reading the various articles on the story from 6 months ago, yes DB was at fault. According to the stories there was a lack of fencing between the yard and a public walkway, a lack of signage, and DB was (or should have been aware of) a chronic trespassing issue given that local people used an abandoned signal box on the site, did graffiti on the site, and site staff had seen the trespassers and done nothing.
  4. Rapido also made the Realtrack 143/144, and time will tell regarding the 142 given that it has been delayed. Revolution have since the above mentioned models gone on to use a different factory, and 1 or 2 products shifted from being done by Rapido to the new factory. As far as I know the only connection between Accurascale and Rapido is that Gareth Bayer left Rapido to join Accurascale.

Rapido announced in their latest newsletter that the latest steam projects, the CPR D10 and CNR H-6, are struggling to get enough orders to proceed with the orders behind what the Royal Hudson achieved in its first week.   13. Not being familiar with building costs in the UK, in the case of this example how would the costs of a cellar/basement compare with building a 3 car garage (which is the case in this example)?

  15. I like the idea/dream of a house set up around the idea of a layout space, but I don't know that you are really getting the resale value part of the equation. Essentially, as mentioned by others, the house portion is far too small to justify a 3 car garage. You really need to make a larger house, either staying on one floor or by going up. Giving that land is often the bigger issue, if I was dreaming I would go up and down. Up to create the additional bedrooms that a family would frequently want, and down for a layout room - but allow for external access to the basement either through sloping property or a ramp into the ground to a doorway. This has the added benefit of requiring either less land, or if one still has room for the exiting design gives more outdoor space to enjoy in the nicer weather (or to grow food), which will also help the resale value.
  16. Only if you actually fill it up with track though. Instead if you use the space to recreate "space", using long stretches of single or double track on a relatively narrow shelf (thus keeping scenery/etc. manageable) and allowing for large radius curves one could have a layout that could be done in a reasonable time frame. The added bonus is with lots of extra space there is room for comfortable chairs and other options that can make spending time with the layout more enjoyable.

  19. Due to the Rapido factories being busy production of the Dash 8-40CM has been delayed, thus Rapido has re-opened the order book for those who still want one.   23. There is still a lot of time between now and whenever (and if) the review is delivered. Whoever is in power come December may have a more immediate problem if the current signs of a possible recession come true, in which case HS2 as a ready source of immediate jobs could be a very attractive way to spend money compared to other initiatives that would likely have a 6 to 18 month lag between announcement and meaningful employment.
