The Stationmaster is correct; exclusivity may be for a defined period and can form part of the contract which we may not be aware of at the time. Anyway, the chances are, with price rises as they go at present that a model may cost less as an 'exclusive' than when it appears in a main range.
I feel then that it would be beneficial for the NRM / Locomotion to clarify exactly what is exclusive about their models at the point of sale
Currently they are offering a standard model of 10000 for £140. This is being sold in the exclusives section but contains no cert, plinth or fancy box (the parts which Bachmann seem to have indicated are the exclusive bits)
Alternatively, I can pre-order the new train pack for £144 and for an extra £4 get 3 rather nicely painted coaches
Seems like a no-brainer to me and I can't see it helping the NRM to have a pile of engines they can't sell

My preference would be a OO9 loco, preferably something cheaper than the L&B loco Heljan are working on. A small welsh slate engine perhaps.

Someone else jumping on the breaking sets up bandwagon. This guy appears to be having a bit of a giraffe in the price department though (I think he thinks its the maroon verison?)
No mention of the tender, wonder if that's extra??

Arrived this morning, packed in too small a box causing damage to front of power car, inter car coupling cut off at the bogies to fit it in box.
Must admit that in the past I have found that sellers who can be bothered to take a good photo or be bothered to describe their item are equally lazy when it comes to packing things properly & communicating. It has made me err on the side of caution when one or two apparent bargains have cropped up.

Unfortunately, consumer rights are all between the buyer and the supplier (not the manufacturer)
The quoted link only refers to distance sales (internet / phone orders) and the returns info only relates to returning orders to the original supplier if immediately found to be faulty (or you are entitled to change your mind and return for a refund)
The sale of goods act relates to all purchases and covers purchases for up to 6 years but again only covers returning goods to the original supplier, not the manuafacturer / agent.

The seller is the one who is responsible for refunding, repair or replacement and although the buyer can request a preferred remedy, the seller can choose the cheapest for them. If you return a loco they can choose to refund and make a deduction based on the use and age (so you could end up with a partial refund and without a loco which is virtually impossible to find and replace)
Returning to DCC supplies is covered by the Dapol warranty which is addition to your statutory rights, therefore they are free to impose their own terms

I feel the response from Dennis yesterday was refreshingly honest and I think Bachmann should be applauded for their acknowledgement of the problem and prompt action. I have always been taught in business that you're judged on how you respond to problems (which are inevitable from time to time)
My only query would be why there seems to be no comment on Bachmanns own website?
