Page 180 of the report states , and I quote :-

This section makes it an offence to trespass upon a railway where a notice at the nearest station warns against trespass. We understand that such a notice is placed at every station.

Doesn't this make every foot crossing, level crossing , footbridge not on a station, and road bridge an offence to cross the railway...?

There is some intriguing stuff in there about the legal status of Network Rail , now it is a private company , and just where it stands on all this..Some lawyer is gonna make a fortune contesting that lot.

The whole thing has largely been dreamt up by lawyers and a certain MSP - all with, basically, nothing else to waste their time and other people's money on as in most cases the existing arrangements are more than adequate although there are a few legal oddities in Scotland which might benefit from review.

I understand from experts (or rather 'the expert') that the whole thing is receiving little or no official interest or backing from where it matters and nothing startling - if anything at all - is likely to emerge from it. But some of it is quite amusing readinglaugh.gif

This is why we have the house of lords. In the unlikely event that parliament is daft enough to try and follow it up (and they follow up some pretty dumb stuff) then the house of lords of full of retired ex judges and lawyers who (after crying into their port) file tons of amendments and turn it into something which their compatriots still practising law actually have some hope of untangling.

Well that's one perspective. Some people have twigged that if the proposals go through it is going to be much easer to close crossings and get LHA's to cough up more money (which would otherwise go on LeMoNs, if they have any cash left). Also some can see ORR using it to gain full powers to draft SIs/ACOPs which they don't have.
